Welcome to the permissions resource page for the Ernest Hemingway Society! The Society is only authorized to grant permission to quote from only a small percentage of Ernest Hemingway’s writings, so please read the following carefully to ensure you request permission from the correct source.

  1. Fiction, Memoir, Essays, Published Correspondence

If you are seeking permission to republish or to quote from any Hemingway fiction, memoirs, essays, or correspondence included in Ernest Hemingway: Selected Letters 1917-1981 (edited by Carlos Baker), please note that you will need to direct your request to Simon and Schuster at the email below. This also includes any request to adapt any of the above works for television, film, or the stage, as well as any request for foreign publication.

  1. Unpublished works and manuscripts

If you are seeking permission to republish or to quote from any previously unpublished Hemingway material (a manuscript, for example), or any material published posthumously in journals or anthologies (such as the original opening of The Sun Also Rises), please note that at this time the  estate is not currently granting permission to publish “unpublished works or derivative material” and explicitly asks that neither the family nor their literary rights manager, Michael Katakis, be contacted directly about this. If there is a legitimate question about permission, Simon & Schuster will refer the enquiry to Mr. Katakis.

  1. Photographs

If you are seeking permission to print Hemingway photographs held at the Ernest Hemingway Collection at the John F. Kennedy Presidential Library and Museum in Boston, Massachusetts, please note that the Society does not hold the copyright on any images. Please consult the archivists at the library for further information.

  1. Foreign Rights/Translations

If you are seeking permission to publish a translation or a non-U.S. edition of any Hemingway work, you will need to contact the Hemingway Foreign Rights Trust via Ms. Yessenia Santos at Simon and Schuster. Please see above for her contact information

What permissions can the Hemingway Society grant?

We consider requests to cite from the following materials:

  1. unpublished letters written by Ernest Hemingway
  2. letters by Hemingway posthumously published in journals, anthologies, or any volume of The Cambridge Edition of the Letters of Ernest Hemingway
  3. selections originally published in 88 Poems

Please note: The Society is authorized to grant permission of the above materials only in the U. S. Permissions for foreign territories must be directed to Simon and Schuster.

Requesting Permissions from the Society

Requests for publication of the above materials will be granted in accordance with the following guidelines:

  • Single quotations should not exceed 150 words.*
  • Multiple quotations from a single work (or letter) should not exceed 10% of that text. *
  • Payment of the fee must be made upon signing permission agreement form.
  • The publication must include notice of copyright for the quoted material as follows: “[year of publication] Printed with permission of The Ernest Hemingway Foundation.”
  • The author must provide a copy of the final publication to the Foundation.

* Except in the case of authorized publication of complete letters or when the author demonstrates to the satisfaction of the Foundation that she or he cannot adequately present or substantiate a critical argument without occasional longer quotations.

Fees
Fees will be determined on the basis of

(1) whether the request is for a commercial or scholarly publication, and

(2) the amount and nature of the material to be quoted.

Form of Request
Requests made to The Ernest Hemingway Foundation should be in the form of a letter or email and must include the following information:

  • a copy of the quotation(s) for which permission is requested;
  • full identification of the passage(s) in the manuscript, collection or anthology;
  • the word count for each quotation;
  • the percentage that each quotation constitutes of the work in which it originally appears;
  • the word count or page length of the manuscript in which the quoted material will appear;
  • a full copy of the publishing agreement or letter of acceptance specifying remuneration;
  • the name and address of the intended publisher, together with full information as to the scope of rights requested and the (a) circulation (in the case of journal publication), or (b) size and nature of the anticipated print run (in the case of book publication).

Fair Use

The Ernest Hemingway Foundation encourages all scholars and writers considering submitting a permissions request to first familiarize themselves with the concept of “fair use.” We recommend the following guidelines and sources:
